DA Hike: While central government employees are eagerly anticipating an increase in their dearness allowance (DA), retired central government employees are looking forward to dearness relief (DR). In the midst of this anticipation, the Supreme Court issued a significant ruling on Friday. The Supreme Court stated that the state cannot treat serving employees and pensioners differently when it comes to increasing dearness allowance. Affirming the equality rights of retired individuals, the bench, which included Justice Manoj Mishra and Justice Prasanna B Varale, rejected the appeals made by the Kerala government and the Kerala State Road Transport Corporation (KSRTC). The court emphasized that inflation impacts both current and retired employees in the same way.

What did Justice Manoj Mishra express?

Justice Manoj Mishra articulated in the ruling, “Equality is a dynamic concept and cannot be confined within conventional boundaries. In fact, equality and arbitrariness are diametrically opposed. One is part of the rule of law in a republic, while the other is the whim of an autocratic ruler.”

Referencing Article 14 of the Constitution (the right to equality), the ruling indicated that while it forbids “class legislation,” it allows for reasonable classification. This classification must satisfy two criteria: it should be based on a well-reasoned distinction, and there must be a rational connection to the objective intended to be achieved.

The bench remarked, “In this case, retired employees are entitled not only to a pension but also to ‘Dearness Relief’ (DR), which is adjusted periodically according to inflation. The concern is not about eligibility for benefits, but rather about the differing rates.” The court concluded that when these benefits are intended for a shared purpose and are tied to inflation, applying different rates for serving and retired employees is arbitrary and discriminatory.

Central employees waiting for allowances

Central government employees and pensioners are awaiting their dearness allowance (DA). This allowance will be applicable for the January to June half-year. The government typically makes a decision on the allowance around Holi, but this time it has been delayed. Even after more than a month of Holi, there is no sign of any progress. Currently, central government employees’ allowance is 58%, which could increase by 2 or 3%. If this happens, the allowance will rise to 60 or 61%. This will be the first time during the Eighth Pay Commission era that the government will announce a dearness allowance (DA).
