Bihar Election Result 2025: The vote counting for the Bihar Assembly elections is in its final stages. Everyone’s eyes are fixed on the election results. Amidst the NDA’s lead in the counting of votes for the Bihar Assembly elections, Jitan Ram Manjhi made a big statement before the results were announced. He said, “Nitish Kumar will be our Chief Minister. We will remain above 160. Nitish Kumar will again ascend to the throne of Bihar’s Chief Minister.”

On the other hand, JDU leader KC Tyagi said, “I had said even before the elections that JDU will win around 80 seats. The Congress Party must change its policy.” As trends emerge, a question arises: Does a candidate who wins an election become an MLA immediately? Or does it have to wait for a formal process? The Election Commission’s certificate is the final seal of approval.

In fact, when the vote count is complete and the Returning Officer officially determines which candidate has received the most votes, a mere declaration is made. Even after this declaration, a candidate cannot become an MLA until they receive a certificate of victory or a Certificate of Election. This certificate is the document that elevates a candidate from winner to MLA status.

Who issues the certificate?
This certificate is issued with the signature of the Returning Officer and the seal of the Election Commission. The candidate must collect it in person, and this is often the most emotional moment, when the public’s trust in the victory is officially documented. This certificate bears the name of the constituency, the total number of votes cast, and the name of the winning candidate.

The formal process doesn’t end there. To join the Assembly as a member, the winner must take the oath of office at the Assembly Secretariat. Only then can they exercise the rights of an MLA, such as salary, government accommodation, or the right to speak in the Assembly.
