If you have not got the property on time, then you can take legal action. Especially if your project is registered with RERA (Real Estate Regulatory Authority), then you have a strong basis.

Process to file a complaint in RERA

Each state has its own RERA website, such as UP RERA, Maharashtra RERA. To file a complaint, first you have to register on the portal. After this, you have to fill out the complaint form, which includes the name of the builder, details of the project, details of the problem, date and amount of payment, as well as all the proofs you have, such as agreements, receipts, and emails.

You have to upload scanned documents. In some states, a fee of Rs 1000 to Rs 5000 has to be deposited. After the complaint is filed, you get a receipt and a complaint number, through which you can track the status of the case.

Recently, Haryana RERA showed strictness in a big case. A buyer got possession after a long delay of 14 years, but the builder did not pay the ordered compensation of Rs 8.6 lakh. This case shows that RERA is now very active in protecting the interests of buyers.

Recourse to the consumer court

If you have faced fraud, deficiency in service, or mental harm, then you can knock on the door of the Consumer Court. Under the Consumer Protection Act, you can demand a refund, compensation, or possession. Filing a case in court requires time and patience, but this is also a strong way for buyers.
