However, this tradition turned into a significant issue for a woman in Delhi. Due to a discrepancy in names, the insurance company withheld millions of rupees from her matured life insurance policy. This situation led to an extensive legal struggle for justice, which ultimately concluded with a victory and a favorable ruling.
Legitimate consumer claims cannot be denied: Commission
The Northeast District Consumer Disputes Redressal Commission, having found the insurance company at fault for a lack of service, mandated that the company refund the entire insured amount, plus interest. After considering the woman’s perspective, the commission’s panel, which included Chairman Surinder Kumar Sharma and Member Adarsh Nain, emphasized in their ruling that a consumer’s rightful claim cannot be obstructed on technicalities.
The woman acquired the insurance policy in 2012
This case centers around a complaint from Preeti Windlesh, who lives in Yamuna Vihar, Delhi. She took out a life insurance policy with ING Life on December 24, 2012. ING Life subsequently merged with Exide Life and later with HDFC Life Insurance Company Limited. When the policy matured in December 2023, the company issued a check for Rs 512,069 in her name. However, the check was made out to her previous name, “Preeti,” despite her having changed her name to “Preeti Windlesh” after marriage and having updated this name in other official documents.
The cheque was rejected due to a discrepancy in the name
When the woman deposited the insurance amount’s cheque in her Kotak Mahindra Bank account, it was returned due to a discrepancy in the name. After this, the woman filed a complaint in this regard with the Consumer Commission. After hearing the woman’s complaint, the Commission directed the insurance company to pay the entire insurance amount of Rs 5.12 lakh along with 9% annual interest from the date of filing the complaint till the payment is made.
Apart from this, an additional Rs 45 thousand has also been ordered to be given to the woman for mental harassment and Rs 20 thousand as litigation expenses.
