Child Passport Rules: There’s significant news for Indian passport holders. According to a law, the father’s name is no longer required for a minor child to obtain a passport. The Delhi High Court, while settling a case, issued a significant ruling and also explained the new rule.
According to the Delhi High Court, a minor child can obtain a passport without the father’s or mother’s name. However, the child must prove that they are under the guardianship of either the mother or father. A bench headed by Justice Purushendra Kumar Kaur delivered the verdict in the case. The Delhi High Court has ruled that if the father has given up his rights, it is not necessary to forcibly include his name. The petition was filed by the mother of a 5-year-old girl, who stated that she had applied for her daughter’s passport without the father’s name, but was denied and filed the petition in the High Court.
Upon investigation, the bench headed by Justice Purushendra Kumar Kaur found that the girl’s parents were divorced. In 2021, when the girl was four months old, they divorced by mutual consent, and the mother was granted custody of the child. The girl’s surname is registered in school with the surnames of her mother and grandparents. She has no documents under her father’s name.
The father did not claim any rights over the daughter
It should be noted that the father did not assert any rights over his daughter during the divorce and settlement, meaning he had relinquished his responsibilities to her as soon as the divorce was finalized. He did not even express a desire to meet the child. The bench commented that such unwanted relationships should not be imposed, and therefore, the father’s name should not be forcibly added to the surname.
The High Court clarified that if, upon reaching adulthood, the girl claims her rights from her father, the passport issued without the father’s name must be cancelled and a passport issued in his name must be issued. However, since the girl is currently under the complete custody of her mother and the father has no involvement in her life, the passport should be issued with only the mother’s name, without the father’s name.
