Court rejected the petition

In such a situation, at least one booth at the toll should be without a fastag, a petition was filed calling it a violation of the fundamental rights of the people. Giving an important decision on this, the Chief Justice of the High Court clarified that people will have to get fastag installed on their vehicles under any circumstances, if this does not happen then the policy of charging double the amount is absolutely correct.

Fastag is mandatory

A bench of Chief Justice Alok Aradhya and Justice Bharti Dangre said on Thursday that the introduction of Fastag is a policy decision. The main objective of which is to provide efficient and smooth road travel, the Fastrack system started in the year 2014 will remain. The court said that we have no judicial justification to interfere in the policy decision of the Center being implemented by the National Highway Authority of India. In such a situation, if you also travel frequently on the highway and have not got your Fastag installed, then get it installed immediately. Otherwise you may have to pay double.

It was urged to keep at least one lane hybrid to allow cash payment. It was argued that due to lack of proper infrastructure, the work of Fastag was successful, due to which passengers are facing problems. He said that there may be people who are not yet used to technology and charging them double toll tax is arbitrary and illegal and it also adversely affects their fundamental right to move freely.

Sufficient time given

The High Court said that Fastag has been made mandatory only after giving time to the public to adopt the change. Also, there is a misconception that the amount collected from not being equipped with Fastag is a fine. There is a provision in the National Highway Fee Rules that such vehicles entering the Fastag lane will have to pay double the fee. In such a situation, the argument of violation of the fundamental rights of the citizens was also rejected by the court.
