RBI Loan Recovery Rules: People often turn to loans when buying a home or car, or during medical emergencies; however, problems arise if they lose their jobs or face a financial crisis. In such situations, borrowers struggle to pay their EMIs. This period brings the mental stress of missed payments alongside the pressure of calls from recovery agents. Agents frequently visit borrowers’ homes, a situation that can take a severe mental toll on individuals.
New RBI Rules
Recovery agents often resort to abusive language and threats, sometimes going to extreme lengths to intimidate borrowers. However, there is no need to worry anymore, as the RBI has introduced new regulations. The RBI has revised the rules regarding loan recovery, and these will be fully implemented by 2027. Once in effect, borrowers will be protected from this kind of mental harassment.
Banks Held Responsible for Misconduct
The RBI has made it clear that banks and other financial institutions must formulate transparent loan-recovery policies and strictly adhere to the ‘Recovery Code of Conduct.’ Banks will be held accountable for any misconduct. The RBI has emphasised that no one can be intimidated or threatened under the guise of loan recovery.
Harassing Friends and Family is Prohibited
The RBI has banned practices such as issuing threats, using abusive language, harassing the borrower’s family or friends, and making calls at odd hours—such as late at night or very early in the morning. All recovery agents must be IIBF certified; existing agents will be given a specific timeframe to obtain this certification.
Restrictions on Calling Times
Under the new framework, recovery agents will not be permitted to call borrowers at any time of the day or night. The RBI has stipulated that recovery calls must not be made before 8 AM or after 7 PM. Banks must establish a monitoring system to continuously oversee their agents’ conduct; recovery agents are prohibited from harassing a borrower’s relatives, friends, or colleagues.
Loan Recovery is a Legal Process
The RBI has clarified that while missing a loan EMI may stem from financial difficulties, this does not grant banks or recovery agents the right to threaten, abuse, or humiliate anyone. Loan recovery is a legal process that must be conducted within the bounds of the law. The RBI is introducing a new framework to clearly distinguish between the recovery process and harassment.
