Consumer Court Complaint: If you have purchased a product or availed of a service and feel you have been cheated—whether the goods turned out to be defective or there was a deficiency in the service—the Consumer Court can help you secure your rights. Even if the shopkeeper refuses to replace the item, you can approach the court to file a complaint. This article explains that filing a consumer case is quite simple, whether done online or offline.
Who can file a complaint?
Any customer who has received defective goods, faced a deficiency in service, or been a victim of fraud can file a case in the Consumer Court. Additionally, others—such as family members, registered consumer groups, or state government representatives—can file a complaint on your behalf, provided the case is based on facts.
Where should the complaint be filed?
The appropriate forum depends on the value of the goods or service and the shopkeeper’s or company’s location. If the value is up to ₹50 lakh, file the case with the District Consumer Commission. For values between ₹50 lakh and ₹2 crore, approach the State Commission, and for values exceeding ₹2 crore, approach the National Commission. You should file the complaint in the jurisdiction where you reside.
What documents are required?
Filing a complaint requires certain essential documents. These include the bill, warranty card, records of written communication with the shopkeeper or company, and proof of purchase. Also, prepare a detailed complaint letter that clearly outlines the defects in the goods or service. These documents will strengthen your case.
How to file a complaint online?
The best part is that you no longer need to visit the court in person; you can file a complaint online from the comfort of your home. To do this, visit e-jagriti.gov.in and create a new account to get a username and password. After logging in, click on the ‘File Complaint’ option. A form will open where you must enter your details and the complaint particulars. Next, scan and upload the necessary documents and pay a nominal fee.
After you submit the form, you will receive a complaint number to track the status of your case. Afterwards, the court will issue notices to both parties and deliver a verdict after a hearing; this could result in an order for compensation or replacement of the product.
How long does it take?
According to consumer protection experts, district-level cases must be resolved within three months, provided product testing is not required. If testing is necessary, the process may take up to five months. Proceedings at the State or National Commission may take longer, though strict regulations are in place to ensure timely case resolution.
Is a lawyer required?
The consumer court system is designed to be simple enough that you do not need to hire a lawyer; you can present your case yourself. However, if the case is complex, seeking legal assistance can strengthen your position. Whether you file a complaint online or appear in court, consumer court helps you fight for your rights. Make sure you have the right documentation and a clear complaint ready; if a shopkeeper or company cheats you, don’t stay silent—always fight for your rights.
