DA Case- Relief for 2 Million People in West Bengal, SC ordered the payment of 25% DA dues to its employees

West Bengal DA Case: The Mamata Banerjee government in West Bengal has faced a significant blow. The Supreme Court has ruled against Mamata’s administration and in favor of the people of Bengal. Indeed, around 20 lakh residents of West Bengal have received substantial relief from the Supreme Court. 

The court has reaffirmed its previous ruling regarding the DA issue. In a decision made on Thursday, the Supreme Court made it clear that the pending dearness allowance (DA) must be paid to state government employees. According to the order, the state government is required to pay 25% of the pending DA by around Holi, with the remaining 75% to be disbursed in installments.

Thanks to the efforts and support of BJP leader Suvendu Adhikari, government employees have gained significant relief from the Supreme Court. The court ruled that dearness allowance must be paid to 2 million employees, granting relief to West Bengal government workers. It ordered the payment of dearness allowance arrears dating back from 2008 to 2019.

When will the payments be made?

The Supreme Court has mandated that 25% of the DA arrears be paid by March 6, following its earlier interim order. It also outlined how the remaining arrears should be paid in installments. A committee has been established by the Supreme Court, led by former Supreme Court judge Indu Malhotra.

What did the court say?

In his ruling, Supreme Court Justice Sanjay Karol emphasized that dearness allowance (DA) is variable and must be disbursed according to the AICPI. The court noted that DA cannot be paid twice. However, the workers’ claims for DA are legally justified. Therefore, there should be no delays in paying DA. The Supreme Court asserted that DA must be paid in accordance with the ROPA rules and the AICPI. DA is a must.
