According to the new rule, most people will now have to return to their home countries to apply for a green card. This means that you won’t be able to apply for a green card while in the US. To obtain a green card, you will first have to return to your home country. Let’s explain the new US immigration rules.
What used to happen earlier for Green Card?
Previously, many people living in the United States on student visas, tourist visas, or work visas were able to apply for a green card while in the United States. This process was called Adjustment of Status (AOS) and was a fairly common procedure. The US government has now amended these rules. The US agency USCIS has made the AOS process a special and limited option. This means that only under very special circumstances will someone be allowed to apply for a green card while in the United States. This new rule has made the process of obtaining a green card slightly more stringent than before.
This rule applies to all individuals in the United States who are living on temporary, non-immigrant visas and wish to apply for a green card. This includes students, tourists, and temporary workers. According to the US Immigration Department (USCIS), those who wish to change their status to a green card must complete this process from outside the United States, i.e., through a US embassy in their home country. Furthermore, officials have been instructed to make individualized decisions about granting this special permission, taking into account all relevant facts in each case.
New rules designed to reduce illegal stays
According to USCIS, those who come to the US on temporary visas must return to their home countries after their allotted time. Now, anyone temporarily residing in the US and wishing to obtain a green card will have to return to their home countries to apply, except in very special cases. This rule has been introduced to prevent people from exploiting loopholes in the system and to ensure they complete the immigration process properly. This will reduce the number of people who remain in the US illegally even after not receiving a green card. Additionally, this new process will reduce the workload on USCIS.
